CHAPTER THREE: MISDEMEANOR CRIMES

3.10 Trespassing: A person commits the offense of trespassing if he or she:

(1) Enters the property of another without permission

(2) A person guilty of trespassing is guilty of a class B misdemeanor, unless signs
upon the property clearly dictate “no trespassing”, in which the person would be guilty
of a class A misdemeanor.



3.11 Stealing: A person commits the offense of stealing if he or she:

(1) Takes property of another without permission from the owner.

(2) A person guilty of stealing shall be guilty of a class B misdemeanor.



3.12 Harassment: A person commits the offense of harassment if he or she:

(1) Causes recurring emotional distress to another by means of speech, stalking, or otherwise
distressing an individual.

(2) It is no defense that the perpetrator is a police officer simply conducting his or her duties.

(2) A person guilty of harassment is guilty of a class B misdemeanor.



3.13 Possession of a Marijuana Plant(s): A person commits the offense of possession of marijuana if
he or she:

(1) Is in direct or constructive possession of a marijuana plant(s).

(2) A person guilty of possession of a marijuana plant(s) is guilty of a class C misdemeanor.



3.14 Reckless Driving: A person commits the offense of reckless driving if he or she:

(1) Operates a motor vehicle on a roadway in such a manner that presents a potential danger to
the public, or the occupants of the vehicle, or

(2) Operates a motor vehicle 25 miles per hour over the posted speed limit.

(3) A person guilty of reckless driving is guilty of a class B misdemeanor.



3.15 Driving While Intoxicated: A person commits the offense of driving while intoxicated if he or she:

(1) Operates a motor vehicle on any roadway and,

(2) Has a blood alcohol content (BAC) of over 0.08 or,

(3) Is otherwise determined to be in an intoxicated condition.

(4) A person guilty of Driving While Intoxicated is guilty of a class A misdemeanor.
